The matrimonial home cannot be sold or transferred without the clear approval of the other party. The parties may have an agreement about who is going to use and stay in the matrimonial home after the divorce. In cases where there is no agreement about this situation, the Judge will decide who leaves the matrimonial home after the divorce by taking into consideration the conditions of each spouse, and the benefits to their children if there are any.
