How does the court decide what orders to make? What factors are taken into account?

For pecuniary and non-pecuniary compensation, the party who claims to have been damaged by the divorce must request these compensations. Pecuniary compensation can be requested if there are damages to their interests and benefits and non-pecuniary compensation can be requested following the violation of the personal rights. The court orders maintenance in favour of the spouse who will need financial support after divorce. The Turkish Court of Cassation states that the Judge will decide whether the spousal can meet his/her needs of food, clothing, health, transport, and cultural costs.
