Applicant: The owner of a trademark registered in a foreign country may apply for trademark registration in Turkey. If the real or legal person who wants to register the trademark does not reside in Turkey, they can register the trademark registered in a foreign country by applying to the Turkish Patent through an attorney residing in Turkey.
Application Petition: The application petition must be prepared in the format determined by Türk Patent and in Turkish. The trademark application is submitted to the Office by filling in the application form accepted as valid by the Office electronically and the necessary documents are submitted.
Formal Review: Turkish Patent examines the formal elements of the application. The application is finalized as of the date, hour and minute when the trademark sample meeting the conditions, the list of goods or services subject to the application and the information showing that the application fee has been paid are all submitted to the Office in full. If there is missing or erroneous information and documents, the applicant shall be notified and given time for correction. If the deficiencies are not corrected within the specified period, the application shall be removed from the process.
Newsletter Publication: If the application complies with the formal requirements, it is published in the Turkish Patent Newsletter. At this stage, objections may be filed by third parties. Therefore, it is important to follow the Newsletter closely.
Appeal Process: The appeals shall be evaluated by the Re-examination and Evaluation Unit and the decision of the Board shall be final and no further appeal may be filed against these decisions before the Board. A lawsuit may be filed against the final decisions of the Board before the Ankara Intellectual and Industrial Rights Civil Court within two months following the notification of the decision. If there is no objection or if the objection is rejected, the process continues.
Registration and Record in the Registry: If the application is accepted, the trademark is registered by Turkish Patent and recorded in the register. The registration certificate is sent to the applicant.
