COVID-19 EFFECTS ON COLLECTIVE LABOR AGREEMENTS

s known, within the scope of the process that runs against rapidly spreading Covid-19 outbreak in our country and in the world, many measures have been taken and continue to be taken in our country. Again, in this context, the Ministry Of Family, Labor And Social Services has sent letters to the Provincial Directorates of Labor and Employment Agencies and reported the decisions made regarding the Coronavirus measures.

 

In the letter sent; firstly, the measures taken in our country so far, such as temporary suspension of general assemblies and all kinds of meetings and activities of non-governmental organizations that bring people together collectively including trainings (except for management activities that require enforcement) of non-governmental organizations (such as associations, foundations), as of 16.03.2020, Monday 24:00 and such as curfew for people who are 65 years old and older and for people with chronic illness, are mentioned. Then, it has been stated that this situation makes it impossible to carry out activities such as collective bargaining and strike voting, which should be carried out in accordance with the Law On Trade Unions and Collective Bargaining Agreements numbered 6356. Some decisions are made in order to prevent problems in running latest terms during collective bargaining agreements as the failure to operate this process may result in loss of rights:

  1. Suspension of affairs and transactions carried out by the Directorate General of Labor and the Competent Office in accordance with the provisions of “Regulation on Collective Bargaining Agreement Authorization and Strike Voting” prepared as based on the Articles 42 and 61 of the Law On Trade Unions and Collective Bargaining Agreements numbered 6356 and “Regulation on Applying to the Mediator and Arbiter in Collective Bargaining Agreement” prepared as based on the Article 57 of the mentioned Law,
  2. The continuation of the membership transactions made through e-Government system within the scope of Law On Trade Unions and Collective Bargaining Agreements numbered 6356 and proceedings outside the scope of the first article of this circular,
