Foreign divorces can be recognised within the Turkish jurisdiction by filing a recognition and enforcement case before Turkish Courts. The following conditions should exist in order for the decision of foreign courts to be recognised by Turkish Courts:
■ There must be a principle of reciprocity between Turkey and the foreign country.
■ The decision should not be made to the exclusive competence of Turkish Courts.
■ The decision should not be clearly against the public order.
■ The other party of the decision should be asked to be present properly before the Foreign Courts and said party should not object to the Turkish Courts depending on this fact.
■ The authorised law should be applied for the decision and the other party should not object to it.
