CONTRACTS WHOSE PRICE IS DETERMINED IN FOREIGN CURRENCY WILL ALSO BE PAID IN TURKISH LIRA

As known; In accordance with the Communiqué No. 32 on the Protection of the Value of Turkish Currency, it has been specifically stated that it is possible to determine the price in foreign currency in the contracts for the sale of movables to be concluded by residents of Turkey with other persons residing in Turkey, excluding vehicle sales contracts.

 

With the Communiqué Amending the Communiqué No. 32 on the Protection of the Value of Turkish Currency published in the Official Newspaper on 19 April 2022, it has been required that the contract price or other payment obligations determined in foreign currency in these contracts must be paid and accepted in Turkish currency.

 

With this amendment, it has been emphasized that there is no obstacle to the determination of the value of these contracts made between residents in Turkey in foreign currency and that in any way the payment must be made in Turkish Lira.

 

Another amendment made with the relevant communiqué is to exclude public institutions/organizations and Turkish Armed Forces Foundation companies from the scope of this obligation. Public institutions/organizations and Turkish Armed Forces Foundation companies will be able to determine the contract price and other payment obligations in foreign currency, make and accept payments in foreign currency, in contracts other than real estate sales and real estate rentals. The Communiqué on the mentioned amendments entered into force as of 19 April 2022, the day of its publication.

 

Within the framework of the statement made by the Ministry of Treasury and Finance after the publication of the Communiqué; it has been stated that within the scope of the performance of the contracts signed before this date, and within the scope of the foreign currency denominated valuable papers that entered circulation before this date, the condition of fulfilling and accepting the payment obligations in Turkish currency will not be sought. Furthermore, it has been stated that the condition of paying the invoices which drawn up before 19 April in Turkish currency and the condition of fulfilling and accepting the precious metals and precious stones purchase and sale transactions carried out in foreign currency in the Borsa Istanbul Inc. Precious Metals and Precious Stones Market and the payment obligations within the scope of the clearing of these transactions in Turkish currency will not be sought.
